ACCOUNTS

To access some features of the website, you are required to create an IAM Studio account. You may not use another person’s account without their permission. When creating your account, you must provide accurate and complete information. You are solely responsible for all activity on your account and must keep your password secure. Notify us immediately of any security breach or unauthorized use of your account. Possessing duplicate IAM Studio accounts with the same name, email address, phone number, or physical address is strictly prohibited. IAM Studio reserves the right to merge such accounts without prior notice. If duplicate accounts are used to gain access to promotions or offers that would not have been available otherwise, the full value of services received will be charged without prior warning.

MEMBER SERVICES AND POLICIES

CANCELLATIONS: You must cancel a class at least 12 hours in advance, or the credit for that class will be deducted. For Unlimited Memberships, a $15 fee will be charged for no-shows (i.e., failing to attend class without canceling at least 12 hours in advance) and for any late cancellations. No-shows also include switching time slots within the 12-hour window. Cancellations can be made online, through our app, or by calling us. YOU WILL STILL BE CHARGED THE NO-SHOW FEE.

PASS EXPIRY AND UPGRADE POLICY: All of our passes are express and come with a 90-day expiry period, as indicated at the time of purchase. In the event of an emergency, we offer an option to upgrade your pass for an additional three months. Please note that we are unable to extend the duration of your current pass; however, you may upgrade it for a fee of $50 plus tax.

LATE ARRIVAL PHILOSOPHY: If you are not signed in at the desk within 10 minutes before class starts, and there are students hoping and waiting for a spot in class, we open the available spots in class to those who are on the waitlist; this means that you may lose your reservation. We also start our classes on time and will not accept any late entry to classes. Once the teacher closes the door – entry is not permitted.

SILENT PRACTICE ROOMS & STUDIO: Our practice rooms are designed to be silent and clutter-free. Please refrain from bringing personal belongings such as bags or cell phones into the practice room. We kindly ask that conversations be kept to common areas and outside the practice room before and after class.

Once the class has started, please avoid entering or exiting the room unless it’s an emergency. If you must leave before class ends, please do so quietly and respect the space of those around you.

Entry to the practice room is only allowed 10 minutes before class begins to give our staff time to prepare the space and allow teachers to get ready as needed.

PROHIBITED USES

You may use the Services only for lawful purposes and in accordance with these Terms.

You agree not to use the Services:

• For any unlawful purposes or in a way that violates any applicable federal, provincial, local, or international laws or regulations.
• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that, in our sole discretion, may harm us or other users or expose them to liability.

Additionally, you agree not to:

• Use the Services for any commercial purpose.
• Use the Services in a manner that could disable, overburden, damage, or impair the Digital Properties or hinder another party’s use of the Services.
• Utilize any robot, spider, or other automated device, process, or means to access the Services for any purpose.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other malicious or harmful materials.
• Use the Services to distribute unsolicited promotional or commercial content, or to solicit other users for commercial purposes.
• Attempt to interfere with the proper functioning of the Services in any other way.

NON-HARASSMENT POLICY

IAM Studio does not tolerate any unwelcome, inappropriate, or offensive conduct from its personnel or members. If you believe you have experienced such behavior, we encourage you to directly and promptly inform the person engaging in the offensive conduct, if you feel comfortable doing so. Additionally, please notify a member of our team by contacting info@iamyoga.ca.

When reporting a complaint, we strongly recommend providing as much detailed information as possible in writing. This should include the following for each incident: date, time, location, names of any witnesses, a description of what was said or done, and any other relevant facts or circumstances.

IAM Studio is committed to thoroughly investigating any reported incidents and ensuring due process for all parties involved. Our responsive actions will depend on the nature of the allegations and cannot be predetermined. We strive to maintain confidentiality throughout the investigation process as much as possible. However, our responsibility to investigate and take appropriate corrective action may require disclosing certain information, so confidentiality cannot be guaranteed.

LIMITATION OF LIABILITY

By creating an account or participating in classes, events, services, activities, and using IAM Studio facilities and equipment, you acknowledge, on behalf of yourself and your heirs, personal representatives, and assigns, that there are inherent risks and dangers associated with the strenuous nature of IAM Studio services. You voluntarily choose to engage in an intense physical exercise program and understand that IAM Studio strongly recommends consulting with a physician before starting any classes. By agreeing to these Terms of Service, you acknowledge that you have been fully informed about the rigorous nature of these group classes and the potential for adverse physiological occurrences, including but not limited to abnormal blood pressure, fainting, heart attacks, or death.

You assume all risks related to your health and well-being and release IAM Studio, its instructors, members, and employees from any responsibility for costs or damages. You also acknowledge that you and any minors under your care fully release IAM Studio from liability. Minors aged 15-17 may participate only with a parent or legal guardian present.

In consideration of being allowed to sign up for, access, or attend services and use the facilities and equipment of IAM Studio (collectively, the “Services”), you acknowledge and agree that you are aware of the inherent risks associated with fitness, exercise equipment, and general equipment used in the Services. You recognize that some risks cannot be eliminated, regardless of precautions taken. You understand and agree that IAM Studio provides the Services “as is” and disclaims all warranties, express or implied, including those of merchantability and fitness for a particular purpose.

Upon entering IAM Studio, you will inspect the premises. Your observation and use of the facilities will indicate that you find them safe and suitable for their intended purposes. If you notice any unsafe conditions, you will cease all activities and promptly inform an IAM Studio employee.

You assume the risk of any accidents or injuries sustained while using IAM Studio facilities and agree to exercise caution to protect yourself and other participants. You understand that specific risks vary by activity and may include, but are not limited to, minor injuries (scratches, bruises, sprains), major injuries (eye injuries, joint injuries, heart attacks), and catastrophic injuries (paralysis, death). IAM Studio is not responsible for covering medical treatment or related costs if you are injured.

You agree to comply with all posted safety signs, rules, and verbal instructions from IAM Studio staff. You are encouraged to consult with your physician before participating in any Services, especially if you have a history of heart disease, high blood pressure, chronic illnesses, or are unaccustomed to physical exertion. If IAM Studio believes you may be at physical risk, you understand that access to Services may be denied until you provide a medical opinion letter from your doctor addressing those concerns.

You assume full responsibility for any injuries or damages related to the Services and agree to release, indemnify, and hold harmless IAM Studio, its affiliates, and all related personnel from any and all claims, injuries, or damages that may arise from your participation in the Services. You represent that you have no medical or physical conditions that would prevent you from using IAM Studio’s Services and have not been advised by a physician against participating in physical exercise. If you have chronic disabilities or conditions, you recognize the increased risk associated with using IAM Studio’s Services.

You acknowledge that IAM Studio makes no claims about medical results from participation in the Services and that only licensed medical professionals are qualified to provide medical advice. You are instructed not to act on any advice from unlicensed IAM Studio employees unless it has been verified by your licensed physician. Furthermore, IAM Studio does not manufacture any fitness or other equipment used in its Services and will not be liable for defective equipment or products.

To the fullest extent permitted by law, you forever release, waive, and discharge IAM Studio from any and all claims, demands, injuries, damages, actions, or causes of action related to your use of or participation in the Services and agree to defend, indemnify, and hold harmless IAM Studio from any such claims.

COPYRIGHT

The content on the IAM Studio website, including but not limited to text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and similar materials (“Content”), as well as the trademarks, service marks, and logos contained within (“Marks”), are owned by or licensed to IAM YOGA PILATES and are protected by copyright and other intellectual property laws. The Content is provided to you for informational and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes without prior written consent from the respective owners. IAM Studio reserves all rights not expressly granted regarding the website and its Content.

You acknowledge that any questions, comments, suggestions, ideas, feedback, or other information you provide regarding the website or services are non-confidential and will become the sole property of IAM Studio.

You agree not to use, copy, or distribute any of the Content except as expressly permitted. You also agree not to circumvent, disable, or interfere with any security features of the website or features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the website or its Content.

“IAM YOGA PILATES” and other graphics, logos, wordmarks, and designs are trademarks of IAM Studio. These trademarks and trade dress may not be used in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used in whole or in part without prior written permission from IAM Studio.

MOBILE SERVICES

The IAM Studio Services may include features accessible via your mobile phone, such as (i) the ability to book and/or purchase IAM Studio credits and classes, (ii) the ability to receive and respond to IAM Yoga messages, (iii) the ability to browse IAM Studio from your mobile device, and (iv) the ability to access certain IAM features through a mobile application you have downloaded and installed (collectively referred to as “Mobile Services”).

While we do not charge for these Mobile Services, your carrier’s standard messaging, data, and other rates may still apply. It’s advisable to check with your carrier to understand the available plans and associated costs. Additionally, some Mobile Services may be restricted or prohibited by your carrier, and not all features may be compatible with every carrier or device. Therefore, please verify with your carrier regarding the availability of Mobile Services for your device and any applicable restrictions.

By using the Mobile Services, you consent to receive communications from us regarding IAM Studio and other related entities via SMS, MMS, text messages, or other electronic means on your mobile device. You also agree that we may collect certain information about your usage of the Mobile Services.

TERMINATION

We reserve the right to terminate your access to the Site at any time without cause or notice. This may lead to the forfeiture and deletion of all information associated with your account. All provisions of these Terms that are intended to survive termination will continue to do so, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

FEES

You acknowledge that IAM Studio imposes fees for its services and reserves the right to modify these fees at our discretion. If your membership is terminated due to a breach of these Terms of Service, you may not be entitled to a refund for any unused portion of your membership or other fees.

REFUND POLICY

CLASSES: All class and credit packages are non-refundable. No exceptions.

MEMBERSHIP: All monthly membership packages are non-refundable. No exceptions. Monthly memberships may be canceled at any time by contacting us via email, phone, or in person. You will not be entitled to a refund for any unused portion of your membership or other fees already paid.

YOGA TEACHER TRAINING: The fee for yoga teacher training is refundable within 30 days, with a retention of a $500 deposit fee. After 30 days, the fee is non-refundable.

RETAIL ITEMS: Unused merchandise may be returned for a full refund within 7 days of purchase, credited to the original payment method. After 7 days, store credit will be issued for returns made within 30 days. No returns or exchanges will be accepted without a receipt. GIFT CARDS: All gift cards are non-refundable. No exceptions. Gift cards cannot be exchanged for cash and will not be replaced if lost or stolen.

CHANGES TO THIS AGREEMENT

We may update these Terms as our business and Digital Properties evolve. Any changes will be posted here, and they will take effect immediately upon posting. By continuing to use the Digital Properties, you accept and agree to be bound by the revised Terms. We encourage you to review these Terms periodically while accessing or using the Digital Properties. For your reference, we recommend printing or saving a copy of the updated Terms.

ENTIRE AGREEMENT & NO WAIVER

These Terms, along with any notices provided through the Digital Properties, represent the complete agreement between you and IAM Studio regarding our services, superseding all prior agreements, discussions, and communications. No waiver of any term within these Terms shall be considered a continuing waiver of that term or any other term. Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision. IAM Studio retains the right to amend these Terms at any time without prior notice. It is your responsibility to review these Terms regularly for any updates. Continued use of the IAM Studio website after any amendments signifies your acceptance of the revised Terms.

SEVERABILITY

If any provision of these additional Terms is found to be invalid by a court of competent jurisdiction, that provision will be deemed severable and will not affect the validity or enforceability of the remaining provisions concerning promotional cards.

FEEDBACK

You may provide comments, reviews, suggestions, or ideas regarding our Services (collectively referred to as “Feedback”). By submitting Feedback, you agree that it is provided on a NON-CONFIDENTIAL BASIS, is voluntary, unsolicited, and without restrictions. IAM Studio does not have any fiduciary duty or obligation regarding your Feedback. You grant IAM Studio the unlimited and perpetual right to use, copy, modify, publish, redistribute, create derivative works from, or otherwise disseminate your Feedback for any purpose without compensation or obligation to you or any third party. IAM Studio retains the right to utilize similar or related feedback or ideas developed by its employees or obtained from other sources.
